1. About This Policy

This Policy explains how reviews work on Candyll: who can write one, who can see what, what content is allowed, how we keep reviews honest, how moderation works, what you promise about content you upload, what rights you give us in it, and how we handle a complaint that content infringes someone's copyright. It applies to Customers, Merchants, and Merchant Staff.

Candyll's review system is deliberately privacy-protective: your star rating contributes to a business's public rating, but the words you write are never shown publicly and are never shown to the business. This Policy describes exactly how that works.

This Policy is one of the Policies incorporated into the Candyll Terms of Service.

2. Definitions

  • Candyll, we, us — Candyll, operator of the candyll.com website and the Candyll mobile app (together, the "Platform").
  • Customer — an individual with a Candyll account who browses, joins, or redeems Deals.
  • Merchant — a business listed on the Platform that offers Deals and is the seller in every transaction.
  • Merchant Staff — an individual granted manager or staff access to a Merchant's account under the Merchant's authority.
  • Review — feedback a Customer submits about their experience after redeeming a Deal Pass with a Merchant, consisting of a star rating and, optionally, written comments, preset feedback tags, and photos.
  • User Content — content you submit through the Platform, including Reviews, photos, and feedback.

Other capitalized terms have the meanings given in the Terms of Service.

3. Who Can Write a Review

Only Customers who redeemed a Deal Pass can review that Deal — a recorded Redemption is a Verified Redemption (an eligibility record), not a Candyll-verified purchase or payment. Every Review is tied to a specific Redemption; there is no way to review a business you have not redeemed a Deal Pass with through Candyll. (Candyll processes no payment for the purchase — you pay the Merchant directly — so review eligibility is tied to your Deal Pass Redemption, not to a Candyll charge.) You can edit or delete your own Review from your account. Merchants and Merchant Staff must not review their own business or a competing business (see Section 7).

4. Who Sees What

This is the heart of the review system. Each part of a Review has a different visibility:

Because Merchants receive only aggregates, they cannot reply to individual Reviews, search Review text, or look up reviewers.

The public star rating shown for a business is an aggregate of individual Customers' own opinions — their separate star ratings, displayed and averaged together. It is not independently verified or endorsed by Candyll, and Candyll does not make its own "verified", "guaranteed", or endorsement claim about any business based on it.

5. Review Photos

You may attach photos to a Review. Photos follow the same privacy-protective model as written comments: they are visible to you and to Candyll for moderation and quality purposes, and are not displayed publicly or shown to the Merchant.

Only upload photos you took yourself, of your own purchase or experience. Do not upload photos that identifiably show other people without their permission.

6. Content Standards

Reviews and other User Content must:

  1. describe your own real, first-hand experience with the purchase you are reviewing;
  2. be lawful — no defamatory, hateful, threatening, obscene, or otherwise illegal content;
  3. respect others' privacy — do not include anyone's personal information (names of staff members, contact details, images of other customers, etc.);
  4. stay relevant to the purchase — a Review is not a place for disputes unrelated to the Deal, promotions, or spam; and
  5. not infringe anyone's rights — only submit content you created or have the right to share.

6A. Your Promises About Content You Upload

Whenever you submit User Content — a review photo, a written comment, or, if you are a Merchant or Merchant Staff, a listing photo, video, logo, menu, description, graphic, or piece of music or audio — you confirm to us that:

  1. you own it, or you hold every licence, permission, and release needed to upload it and to have it used as this Policy describes — including permission from anyone identifiable in a photo or recording;
  2. you have the authority to grant the limited licence in Section 9;
  3. you will not upload infringing material of any kind — photos, videos, logos, menus, descriptions, graphics, music, or other works that belong to someone else;
  4. you will not copy content from Google, social media, another marketplace, or a competitor and pass it off as yours or use it without the owner's permission;
  5. you are responsible for third-party claims arising from the content you supplied, and you will not leave Candyll to answer for a claim about it;
  6. you will cooperate with a complaint investigation — if we receive a complaint about content you uploaded, you will respond to our questions within the time we ask; and
  7. you will remove or replace content when we require it, if it turns out to infringe, to breach this Policy, or to be the subject of a well-founded complaint.

A Merchant's obligations for the content it publishes, and its indemnity for claims about that content, are in the Merchant Terms; nothing in this Section creates a second, separate indemnity.

7. Keeping Reviews Honest

Honest reviews are the point of the system, and misleading reviews can also break Canadian law, including the federal Competition Act's rules against false or misleading representations. On Candyll:

  1. No fake reviews. Do not submit a Review of an experience you did not have, and do not help anyone else do so.
  2. No self-reviews or competitor reviews. Merchants, their owners, and Merchant Staff must not review their own business, and must not review competing businesses to harm them.
  3. No incentivized reviews. No one — Candyll, a Merchant, or anyone else — may offer money, discounts, free products, or anything else of value in exchange for a Review or for a particular rating. Reviews written because of an undisclosed material connection to the business (payment, employment, family relationship, free product) are prohibited.
  1. No pay-for-removal. Merchants may not offer refunds, discounts, or anything else on the condition that a Customer changes or deletes a rating, and cannot pay Candyll to remove or improve ratings.
  2. No selective display. A business's public aggregate rating reflects all visible ratings — Candyll does not curate aggregates to favour Merchants. Ratings are excluded from the aggregate only when a Review is hidden for violating this Policy.

Violations may lead to removal of the content and enforcement action under the Platform Access & Suspension Policy.

8. Moderation

Candyll may — but is not obligated to — review User Content for compliance with this Policy. Because Review comments and photos are not public, moderation mainly protects the integrity of ratings and addresses unlawful content.

  • Hiding. We may hide a Review (removing its rating from the aggregate) where we reasonably believe it violates this Policy or the law — for example, fake or incentivized reviews, or unlawful content.
  • Notification. If your Review is hidden, we will notify you at the email on your account with the reason, unless the law prevents it. You may respond and ask us to look again; the appeal process in the Platform Access & Suspension Policy applies.
  • We do not edit. We hide or unhide content; we do not rewrite what you said.
  • Preservation. We keep moderation records so decisions can be reviewed.

Moderation is a right we exercise in good faith, not a guarantee that all content complies with this Policy at all times.

9. Your Licence to Us

You own the User Content you create. So that the Platform can function, you grant Candyll a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, resize, generate thumbnails of, moderate, distribute within the Platform, display, and preserve as evidence your User Content — only as necessary to operate and provide the Platform, and only within the visibility model described in Sections 4 and 5 — and to use it in de-identified, aggregated form (for example, computing a business's average rating or tag counts) for operating and improving the Platform and for displaying those aggregate figures. The licence goes no further than those purposes. It does not allow us to publish your Review comments or photos publicly, to show them to the Merchant, to attach your name to content shown to Merchants, to use your content in advertising, or to sell or license your content to anyone else.

Moral rights — a limited consent, not a waiver. Displaying content on a platform means it gets resized, cropped to a thumbnail, laid out on a screen, shown next to other content, and sometimes hidden by moderation. So that we can do those ordinary things without infringing your moral rights, you consent to the technical formatting, resizing, thumbnailing, cropping for layout, compression, moderation, and platform display of your User Content as described in this Policy. That is the whole of it: you are not waiving your moral rights generally, you keep your right of attribution and integrity beyond this limited consent, and we do not ask you to give up moral rights for uses this Policy does not describe.

If you delete a Review or your account, the licence and the consent above end for future use, except that: (a) aggregate figures your rating already contributed to are recalculated on deletion where feasible; and (b) copies may persist for a limited period in backups and in records we must keep — including records preserved for an open content or copyright complaint (Section 10) — as described in the Privacy Policy and the Data Retention & Account Deletion Policy.

10. If Content Is About You

If you believe User Content or Merchant-published content on the Platform is unlawful, infringes your rights, or violates this Policy — for example, it is defamatory or uses your personal information or your work without permission — notify us at admin@candyll.com with: (a) where the content appears, (b) who you are and how to reach you, and (c) why the content is unlawful or infringing. We review such notices promptly, take the action we consider appropriate (including hiding or removing content), and respond to the notifier.

10A. Copyright Complaints

Our position. Candyll maintains a copyright complaint, notice-forwarding, evidence-preservation, and content-restriction process. *The precise statutory application of sections 41.25 to 41.26 of the Canadian Copyright Act to Candyll's marketplace and hosting functions remains subject to legal classification. Whatever that classification turns out to be, we operate the process described here. This is a Canadian process — it is not* a United States DMCA takedown process, and describing a complaint as a "DMCA notice" does not change how we handle it.

How to send a copyright complaint. Write to admin@candyll.com, which is our monitored address for content and legal notices. To let us act, tell us:

  1. your name and a contact address;
  2. what the copyrighted work is;
  3. why you own it or are authorized to act for the owner;
  4. the exact Candyll page, listing, or content identifier where the material appears;
  5. what the alleged infringement is;
  6. the date and time you saw it;
  7. any supporting documentation;
  8. a good-faith statement that the use is not authorized; and
  9. your signature or an electronic confirmation.

A notice that instead contains a settlement offer, a payment demand, a demand for the uploader's personal information, or a payment or personal-information link is flagged and does not get forwarded in that form.

What we do with it. We record the complaint, check whether it contains what is listed above, identify the content and the person who uploaded it, preserve the relevant records, forward the substance of the complaint to the uploader where that is appropriate, restrict the content temporarily where that is reasonably necessary, consider any response, and then decide whether to restore, qualify, restrict, or remove it. We tell the claimant the outcome. Repeat infringement leads to escalation under the Platform Access & Suspension Policy, up to loss of access.

What we do not promise. We do not automatically remove content on every allegation — an allegation is not a finding, and some complaints are mistaken, incomplete, or abusive. Equally, Candyll may restrict or remove content under the Terms of Service and this Policy without thereby admitting that infringement occurred or accepting any claim.

Uploader identity. We do not give a claimant the uploader's name, email address, or other personal information without that person's consent, lawful authority, a court order, or another valid legal basis. Forwarding a complaint to an uploader does not tell the claimant who the uploader is.

Preservation and retention. If it is confirmed that section 41.26 applies to a particular notice, we support: forwarding the notice electronically to the uploader as soon as feasible; telling the claimant that the forwarding occurred or, if it could not, why not; preserving records capable of identifying the relevant uploader; keeping those records for six months from the day we received the notice; and extending that to one year where we are given notice that proceedings have been commenced and the statutory condition applies. Until the classification question is settled, we may follow the same conservative workflow as an operational practice — subject to our privacy, legal-hold, and data-minimization obligations, so that records we hold for this purpose are restricted, used only for it, and destroyed when the period ends. The record class is in the Data Retention & Account Deletion Policy.

11. How This Policy Fits With Other Documents

These documents form one agreement. This Policy governs Reviews and User Content — visibility, standards, integrity, moderation, and licence detail — and on that topic it prevails over the Terms of Service. The core licence grant lives in the Terms of Service; this Policy narrows and explains how it is exercised. Privacy aspects of Reviews (what data is collected and how long it is kept) are governed by the Privacy Policy. Nothing in any document limits rights you have under applicable law that cannot be waived — if any provision conflicts with such a right, the right prevails. This Policy is incorporated into the Terms of Service and carries its own version and effective date.

12. Changes to This Policy

We may update this Policy from time to time. Material changes — especially any change to who can see your Review content — will be announced with reasonable advance notice as described in the Terms of Service. We will never retroactively make previously submitted private Review comments or photos public without your consent.
